Generative artificial intelligence (AI) and large language models (LLMs) have made astonishing progress in the past twelve months. Today, freely available AI services like ChatGPT, Midjourney, and DALL-E can generate impressive images, poetry, scripts, computer code, research materials, legal documents, and even seminar invitations at the click of a button. These advances and others in the field of AI are testing the limits of long-established intellectual property concepts like copyright authorship and derivative works and raise a host of potential legal, ethical, and liability concerns, from digital “hallucinations” to deepfakes.
